1. Introduction and Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website `ds.click` (the "Site") and its associated link shortening services (collectively, the "Service"). The Service is owned and operated by Jakub Lukeš (IČO: 22024107), located in the Czech Republic ("Operator", "we", "us").

By creating an account, accessing the Site, or using any part of the Service, you signify that you have read, understood, and agree to be bound by this legally binding agreement. If you do not agree to these terms, you must discontinue use of the Service immediately.

2. The Service

The Service provides users with tools to create, manage, and analyze shortened, customized URLs ("Shortened Links"), particularly for the Discord platform. We offer both a free tier and paid premium subscriptions with enhanced features.

The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue the Service, or any part thereof, at our sole discretion, with or without notice. We are not liable for any modification, suspension, or discontinuance of the Service.

3. User Accounts and Eligibility

To use the Service, you must create an account by authenticating through Discord's OAuth2 protocol. By doing so, you grant us permission to access certain information from your Discord account as detailed in our Privacy Policy.

Age Requirement:

You must be at least 15 years of age to use this Service. This is in compliance with Czech Act No. 110/2019 Coll., which sets the age of consent for personal data processing at 15. By creating an account, you warrant that you meet this age requirement.

Your Responsibilities:

• Maintaining the security of your Discord account. The security of your `ds.click` account is directly tied to it.
• All activities that occur under your account.
• Ensuring the email address associated with your Discord account is accurate and current.

4. Acceptable Use Policy

You agree not to use the Service to create, share, or distribute Shortened Links that redirect to, host, or promote any prohibited content. Your use must comply with all applicable laws and with the Discord Terms of Service and Community Guidelines. Prohibited content includes, but is not limited to:

• Malicious content (malware, phishing, viruses).
• Illegal content and activities (terrorism, CSAM, sale of illegal goods).
• Hate speech, harassment, and discrimination.
• Harmful misinformation and fraudulent schemes.
• Sexually explicit material or non-consensual intimate media.
• Content that infringes on intellectual property rights.
• Spam, deceptive redirects (cloaking), or doxxing.

We reserve the right to investigate violations and take appropriate action, including disabling links, suspending, or terminating your account without notice or refund, and reporting activities to law enforcement.

5. Subscriptions, Payments, and Cancellations

Premium features are available through a paid subscription ("Subscription"), billed in advance on a recurring basis (e.g., monthly, annually). By providing a payment method, you authorize us or our third-party payment processor (e.g., Stripe) to charge the recurring fees.

You may cancel your Subscription at any time through your account settings. The cancellation will take effect at the end of the current billing period.

All subscription fees are non-refundable, except as required by applicable law.

6. Intellectual Property

The Service and its original content, features, and functionality are the exclusive property of the Operator and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of the original URLs you submit ("User Content"). However, to operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and redirect your User Content solely for the purpose of providing and maintaining the Service.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including a breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

The Operator is not responsible for any third-party content linked to via the Service. You access destination URLs at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Czech Republic. You agree to submit to the exclusive jurisdiction of the competent courts located in the Czech Republic for any disputes.

10. General Provisions

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or by posting a notice on the Site. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
